1. Ownership of Site; Agreement to Terms of Use

These Terms and Conditions of Use (the “Terms of Use”) apply to the geekTV web site www.iamgeek.tv and related domains (the “Site”). The Site is the property of Player X Limited (“PLAYER X”) and its licensors. BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE SITE.Player X reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Player X grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site. Definitions "Territory" means the United Kingdom and Ireland.This agreement only applies to the Territory.

2. Content & Law

Content is non-exchangeable and non-refundable. The content is generally suitable for mature audiences and therefore the service is strongly recommended for use by those 15 years and over. Governing Law All matters relating to your access to or use of the Site, including all disputes, will be governed by the Laws of England, Ireland and Wales. Any disputes shall be dealt with by the English courts. If any provision of these Terms and Conditions is determined to be illegal or unenforceable by a court of competent jurisdiction the relevant provision shall be deemed to be removed without affecting the effect of the remaining provisions.

3. Ownership

The Service belongs to Player X and the content contained on the Service is owned or controlled by or licensed to Player X. All rights reserved. Unauthorised copying and/or reproduction of any part of the Service or any content on the Service is strictly prohibited. All trademarks and trade names are the property of their respective owners. You agree that any content obtained from the Service is for your own personal use and may not be distributed to third parties or exploited in any commercial manner whatsoever. You must not modify, copy, distribute, reformat, display, license, transmit, sell, perform, publish, transfer, reverse engineer or decompile (or attempt to do any of the same) or otherwise make the content available other than as expressly authorised by Player X. You must not use the Service in any way which would cause the whole or any part of the Service or any content on the Service to be damaged, rendered less efficient or impaired in any way.

4. Purchases; Other Terms and Conditions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the latter terms shall control with respect to your use of that portion of the Site or the specific service. Player X’s obligations, if any, with regard to its products and services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such agreements. Player X may make changes to any products or services offered on the Site, or to the applicable prices for any such products or services, at any time, without notice. The materials on the Site with respect to products and services may be out of date, and Player X makes no commitment to update the materials on the Site with respect to such products and services.

5. Data Protection

Player X will comply with the requirements of the Data Protection Act 1998 in the way we handle any personal data we collect from you. Our site involves the collection of personal information, such as names, address and telephone numbers on an opt-in basis only. Player X uses the information to help provide a better service and to provide information on our products and services. Player X may also use the information to recommend to you to you content which we think would be of interest to you.

6. Customer Care

Player X is responsible for dealing with inquiries or resolving complaints concerning the content on the Service. Please contact us at help@iamgeek.tv. Player X cannot deal with complaints which relate to the mobile network service provided by a mobile operator.

7. Modification Player X reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend or terminate operation of or access to the Site, or any portion of the Site, for any reason; (2) to modify or change the Site, or any portion of the Site, and any applicable policies or terms; and (3) to interrupt the operation of the Site, or any portion of the Site, as necessary to perform routine or non-routine maintenance, error correction, or other changes.

8. Self Publication ContentThe Site may permit self-publication services such as, but not limited to, the submission of videos, images or other communications submitted by you and other users ("User Submissions") and the hosting, sharing, and/or publishing of such User Submissions. You understand that whether or not such User Submissions are published, Player X does not guarantee any confidentiality with respect to any submissions.

Licenses / Permissions

You shall be solely responsible for your own User Submissions and the consequences of publishing them. In connection with User Submissions, you affirm that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorise Player X to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions; and (ii) you have the written consent and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the site and these Terms of Service.

By submitting User Submissions to geekTV, you hereby grant Player X a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with geekTV and Player X's (and its successor's) business, including without limitation for promoting and redistributing part or all of the geekTV site (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the geekTV site a non-exclusive license to access your User Submissions through the site.

Limitation of Liability In connection with User Submissions, Player X does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Player X expressly disclaims any and all liability in connection with User Submissions.

You understand that when using the geekTV site Player X is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Player X with respect thereto, and agree to indemnify and hold Player X, its Owners/Operators, affiliates, and/or licensors, against any liability, action, proceeding claim or demand arising out of or in connection to matters related to your use of the site.

Moderation

All self-publication services will be monitored to ensure compliance with the laws of Territory at all times. Player X will remove all User Submissions if properly notified that such User Submission infringes on another's intellectual property rights. Player X reserves the right to decide whether a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law. Player X may remove User Submissions that are in violation of these Terms of Service or otherwise inappropriate as it requires at any time, without prior notice and at its sole discretion.
